This position provides legal support to the Department of Health's 13 Professional Licensing Boards. The incumbent also serves as a Special Assistant Attorney General. Duties may include acting either as General Counsel or as "Prosecuting Attorney" for a professional licensing board. Duties as General Counsel for a board include providing legal opinions and advice to the board staff; drafting legislation and administrative rules; assisting with the Request for Proposals and contract drafting; advising on open meetings and open records; ensuring the board is in compliance with federal and state statutes and administrative rules; and acting as hearing officer to the board in a contested case. Duties in the role of "Prosecuting Attorney" for a licensing board include handling all complaints and disciplinary action and representing the board staff seeking disciplinary action against a licensee, when necessary. The incumbent will work with the Department of Health's general counsel and any outside counsel retained by a licensing board.
This position is exempt from the Civil Service Act.
Licenses and Certifications:
Graduation from an accredited school of law and member of the South Dakota State Bar is required.
The Ideal Candidate Will Have:
Experience in administrative and criminal procedures. 
Knowledge, Skills, and Abilities:
  • criminal and civil practices and procedures;
  • evidence and constitutional law, and the current national and state trends;
  • state administrative practices and procedures;
  • legal research techniques, including use of technology;
  • basic computer operations and applications;
  • deal tactfully with others;
  • communicate clearly and concisely;
  • prepare clear and concise documentation, reports, and correspondence;
  • analyze facts, evidence, and precedents and arrive at a logical interpretation;
  • work in harmony with professional medical staff, private attorneys, circuit court officials, tribal courts, and advocacy services;
  • ability to identify and solve problems proactively;
  • work independently while following instructions and accepting guidance;
  • effectively manage a large and varied case load.
