The Iowa Department of Education is looking to fill an Attorney 2 to assist the state.

The successful candidate will advise Division Administrator, Bureau Chiefs, and Division staff on questions state and federal special education law other state and federal law relating to school improvement, including statutes, rules and regulations, proposed regulatory or statutory amendments, and case law; recommends interpretation and Department action.

Drafts proposed legislation and proposed rules relating to special education and other laws relating to school improvement. Advises and assists legislative committees and state boards and commissions in matters concerning special education law and laws relating to school improvement. -Drafts public comment to proposed changes in federal special education regulations.

Provides information and technical assistance to Iowa's school districts, area education agencies, accredited nonpublic schools, partner agencies, and parents regarding special education law and other laws relating to school improvement; provides training and in-service activities; drafts guidance documents.

Works collaboratively with the Department's counsel and with the Department's assistant attorney general. Assists attorney general in its representation of the Department in special education litigation in which the Department is a named party. In collaboration with the attorney general's office, provides representation to the Department in formal mediation or informal negotiation concerning special education matters where the Department may be named as a party in potential litigation.

Drafts and coordinates memoranda of agreements between the Department and other state agencies involved in the education and care of children with disabilities.

Provides advice, information, interpretations, and recommendations to the Department regarding other laws relating to children in vulnerable populations, including state and federal laws concerning the rights of persons with disabilities and relating to the education of children in foster care.

Hears and investigates complaints filed with the Department under Parts B and C of the Individuals with Disabilities Education Act; gathers and reviews factual record; makes decisions on questions of fact and law; orders reimbursement, compensatory education, or other appropriate relief.

8:00 a.m. – 4:30 p.m., Monday – Friday with some in and out of state travel, nights and weekends

Seeking candidate with active license to practice law in Iowa and in good standing.

Applicants must have graduated from an accredited school of law to qualify for positions in this job classification.
